Offer Terms & Conditions
a. This document is an electronic record in terms of Information Technology Act, 2000 and applicable Rules thereunder and the provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
b. Samsung India Electronics Pvt. Ltd. (Samsung) introduces an offer (Offer) on Galaxy S7 & S7 edge (Device) under which a buyer of the Device (You or Customer) can avail a Gear VR at 50% discount on purchase of the Device subject to the terms and conditions stated herein.
c. The Offer shall be available from 18th March to 30th April, 2016. Any Customer who purchases the Device from Flipkart (Online) during 18th - 30th April 2016 and activates (as per FOTA/IMEI) by 7th May, 2016 will be eligible for the Offer.
d. The online booking can be done on Flipkart i.e. www.flipkart.com or the Flipkart Shopping App.
e. In order to receive the Gear VR at 50% discount, Customer will have to activate (turn the Device on with the SIM inserted) the Device by 7th May 2016, failing which he/she shall not be eligible for the offer. The phone should be activated with a unique mobile number which has not been earlier used for the Device during the pre-booking offer which was available during 8th March - 17th March 2016.
f. The number used to activate the Device for this offer, should be inserted for a minimum period of 7 consecutive days from the date of inserting the SIM in the primary slot. If the number is either removed or changed or inserted in some other handset, the offer might not be available. Example - If a Device is purchased during the offer period is activated on 7th April 2016, the Customer shall retain the same mobile number & same SIM inserted in primary slot till 13th April 2016 in the Device.
g. Only one Device can be booked against one mobile number. The Customer acknowledge and agree that his/her personal information including but not limited to his/her name, contact details and address shall be shared with Samsung for the purpose of providing the Gear VR at the discount amount specified above under this Offer. The Customer authorizes Flipkart to share such information and thereby release and discharge Flipkart from all claims of any kind which may exist or arise as a result of sharing such information. The Customer hereby agrees to be bound by these terms and conditions. If he/she does not agree to any of these terms and conditions, he/she is requested not to proceed with this transaction.
h. Once the Customer receives/collects the Device he/she will have to follow the process given hereunder to redeem the Gear VR at 50% discount. The Process to redeem the discount on Gear VR is as under:
Go to My Galaxy application/ Download from Google Play Store on the Device received from Flipkart during the Offer period.
If You are already enrolled to the program with the same mobile number, sign in with the existing details.
Fresh enrolment/sign in to My Galaxy must happen by 30th April 2016 failing which You will not be eligible for the Gear VR offer at 50% discount.
Fresh enrolment/sign in to My Galaxy to be done with same mobile with which activation was done. In case any other mobile number is used You will not be eligible to avail the offer.
Offer will be visible in My Galaxy app from 5th April after activation. Post registering / signing in to My Galaxy, You can generate your coupon.
Coupon will be valid for one time use only against redemption of Gear VR.
Coupon can be redeemed on www.samsungindiaestore.com only, on or before 7th May 2016.
The shipping of Gear VR will happen within 90 days from 31st May 2016 onwards.
i. In case of booking of the Device through Flipkart the Device shall be delivered by Flipkart to the Customer through its logistics partners respectively and Samsung India Electronics Pvt Limited will not be responsible or liable for supply of the Device including but not limited to the following:
Any wrong submission of required details including but not limited to shipping details;
Any failure to receive submissions due to transmission failures and other conditions beyond its reasonable control;
Any late transmissions or entries;
Any computer or communications related malfunctions or failures;
Any delay, damage, non receipt, lost, misrouted delivery of Device.
Any delay due to non-availability of stocks or for any other reason beyond its control.
Any delay or loss or damage due to Act of God, Governmental actions, and any other force majeure circumstances.
j. Once the Device is delivered to the Customer and activated within the stipulated time as mentioned in the above clauses, Samsung India shall be responsible only for the delivery of the Gear VR at 50% discount to the eligible Customers who have fulfilled the above mentioned requirements to avail the offer.
k. A Customer who fails to download the My Galaxy App and generate the discount coupon within the stipulated time, his/her discount coupon shall stand forfeited and no claims shall be entertained in this regard either against Samsung or Flipkart.
l. This Offer is being run solely by Samsung and all liability with respect to the 50% discount coupon its delivery lies with Samsung. Flipkart Internet Pvt. Ltd. (Flipkart) shall be responsible for the delivery of the Device only and in no way responsible for redemption of the discount coupon. Flipkart does not provide any representation or guarantee on behalf of Samsung or commitment in regard to the fulfillment of terms of the Offer. Flipkart shall not in any manner whatsoever be liable for any acts or omission (including any charges payable) of Samsung or for any loss, injury or any other liability arising due to participation by any person in the Offer vis Samsung shall also not be responsible for late delivery or the Device to the Customer resulting in ineligibility of the Offer to him/her.
m. Samsung reserves the right to change, extend, amend and/or withdraw the Offer or change any of these terms & conditions anytime without prior notice.
n. All disputes shall be subject to exclusive jurisdiction of courts located at Gurgaon.
